How a plaintiff's attorney can help you if you've become disabled
By
EsteyBomberger
A plaintiff's attorney, or a personal injury lawyer is a lawyer who represents people who are wrongfully injured. If your
spinal cord injury
or brain injury was a result of someone else then you don't have to shoulder the financial burden yourself. Legally they are liable to pay for the suffering they have caused you.
Plaintiffs attorneys help people who have become paralyzed or disabled:
• on the job / in the workplace
• after a car accident / motor vehicle accident
• as a result from falling (premises liability)
• injured by a dangerous product
• medical malpractice (birthing injury, surgery error etc)
You must establish their negligence, whether it be in poor care, dangerous conditions etc. The settlement can help pay for your: reduced quality of life, medical expenses, hospital bills, past and future loss of income etc. It usually considers the entire cost of your injury throughout your life, and several clients secure several million dollars. If you don't have health insurance (as more than 40% of spinal cord victims don't at the time of their injury) then your lawyer can also sometimes help you find no cost healthcare. Even if you were partially at fault, then the other party is responsible for the percentage of the accident that was their fault.
Plaintiffs attorneys are also
affordable
. Platintiff's attorneys usually don't charge anything upfront of their services, and instead are paid a fixed percentage of any settlement.
The majority of plaintiffs attorneys offer free consultations- and if they take your case they essentially perform all the legal work for you. Most also accept contingency fees which means they can take your case at no upfront cost and *if* they lose, there is no charge to the client and the firm absorbs the cost. We encourage you to speak to as many lawyers as possible until you find one that not only you are comfortable with, but you are confident in their ability to represent you. We understand platiff law doesn't rewrite the injustices caused to the victims, but we hope it can help coping with the disability financially more feasible.
For example, one of our clients received $17,550,000 in a products liability case against the manufacturer of loader/back- hoe, which resulted in him becoming triplegic. Because our firm only helps those in California, we are not able to answer specific questions outside of the state as each jurisdiction handles these cases differently. However we just wanted to let people know who are seeking justice for their injuries that it is not a financial burden you have to shoulder alone. Money can not compensate for the reduced quality in life, but it can help abate the outstanding financial and medical costs.
